Introduction

This Privacy Policy ("Privacy Policy") describes the way that Remedy Well Inc. and its affiliates, (collectively, "we," "our,” “us", “Remedy Well), may handle your information from the time you access our website, applications, platform, and associated Services. This Privacy Policy is incorporated into our Terms of Use. All capitalized terms used herein have the meaning assigned to them in the Terms of Use and Consent to Telehealth.

This Privacy Policy applies to information we collect: On this website; and In email, text, and other electronic messages between you and this website which provide dedicated non-browser-based interaction between you and this website.

About HIPAA

The Health Insurance Portability and Accountability Act of 1996 (HIPAA) is a federal law that was established as a means of setting a national standard when it comes to protecting the medical records and identifiable health information known as “protected health information” or “PHI”. The law applies to Health Care Providers, clearinghouses, and health plans who collect and transmit health information as “covered entities”, requiring specific safeguards be established to protect the security, confidentiality, integrity, and availability of such PHI from unauthorized collection, use, and disclosure, granting individuals the right to be informed about how their information is protected and about how their PHI is used.  

What Information We Collect & How

Remedy Well collects a variety of information that you supply to us when you access our website, platform, and Services. This information is provided to us in many ways including while:  Registering for an account Completing surveys and/or questionnaires Asking questions or providing feedback Emailing or chatting with Remedy Well, its support, Providers, and Health Coaches Uploading images and documents to our applications and platform Placing orders within our eCommerce platform Subscribing for Remedy Well Services The information collected may include:  Full name, email address, phone number, birthday, phone number and mailing address, including demographic information such as your race/ethnicity, sex assigned at birth, gender, marital status, and similar information. Medical history, conditions, allergies, active medications, past surgeries, genetic conditions, mental health conditions, medical photos, lab results and similar information. Billing information such as your credit or debit card number, security codes, expiration dates, shipping information, information about your purchases and all transactions. Your government identification card, signature, and insurance card information. Login credential information used in the establishment of an account. Third parties may also supply us with information, including medical professionals, pharmacies, advertising agencies, and marketers, amongst others. Anonymous demographic information, which is not unique to you, such as your zip code, age, gender, preferences, interests, and favorites. And any other information that you elect to share with us or publicly share such as via social media about any of the Services or products received from Remedy Well, including when you like, comment, or follow us on Social media, or download any future applications connected to Remedy Well.

How We Use Your Information

We use your information to:  Enhance communication with users Provide personalized content and experience Better understand needs and make offers that are relevant Communicate about new products and services Inform our Providers, partners, and affiliates providing you care Provide top support services Improve website, apps, platform, and Services Verify identity when accessing our Services Traffic and user activity analysis For marketing and/or promotions  Remedy Well may collect other information. Using automated means to do so, information retrieved may include your IP address, browser type, state, country, entry pages, exit pages, and referring sites, via web server logs, tracking and analytics tools like Google analytics, including tracking pixels, tags, IDs, and cookies. Remedy Well reserves the right to employ new technologies in information gathering, and this Policy will be updated as they are used.

Cookie Information

Cookies are files that include unique identifiers that are sent by web servers to browsers and can be used to identify and track users as they navigate and return to our website. You may deactivate cookies by opening your browser preferences and under “Help” selecting searching for “cookies” and either unchecking “accept cookies” or selecting “block cookies”. It should be noted that by blocking all cookies, you may not be able to use certain features on a website, which may have a negative impact on the usability of certain websites.

How We Share Information

Your information may be shared or disclosed for the reasons mentioned below. Although each of these categories are briefly explained herein, not all use types are covered. You do not need to sign consent for us to use or disclose your information for these listed purposes.  

Providers, MSO & Medical Group:  Remedy Well will use your health information in the provision and coordination of your health care. We may disclose any portion of your medical record information to your consulting physician(s) or nurse practitioner(s), registered nurses and other Health Care Providers who have a legitimate need for such information in your care.

Third-Party Service Providers:  Remedy Well may provide access to or share your information with third parties that perform certain services on our behalf such as for billing, payment, laboratory requisitions and interpretations, pharmacy, sales, marketing, analytics, research, shipping, data storage, security, IT, auditing, consulting, or legal services.

Other Business Associates : Remedy Well may use and disclose certain health information about you to its business associates, affiliates, and subsidiaries. These include individuals or entities under contract with Remedy Well to perform or assist in a function or activity that necessitates the use or disclosure of your information.  Examples include but are not limited to, our partners, consultants, independent contractors, accountants, lawyers, physicians, pharmacies, laboratory providers, medical transcriptionists, and third-party billing companies. Remedy Well requires the business associate to protect the confidentiality of your medical information.  In addition, Remedy Well requires any subcontractor of Remedy Well’s business associate to protect the confidentiality of your medical information.

Regulatory Agencies : Remedy Well may disclose medical information about you to public health, in response to lawsuits, legal action, or investigations of abuse. Under State law, if you communicate a specific and immediate threat that involves bodily injury or death, to an identifiable person, and we have reason to believe you have the intent to credibly carry out that threat, we are legally required to respond. Responses may include (1) warning the potential victim(s), or their guardians if a minor, and notifying Law Enforcement.

Emergency Personnel : If you experience a life-threatening emergency and we cannot gain your consent, we reserve the right to share your information.

De-identified Information:  Remedy Well may de-identify your information that we collect through our Services and use such information at our discretion for any business or purpose not prohibited by law.

Information We Retain

Remedy Well along with our affiliated Management Services Organization ("MSO") and Medical Professional Corporation ("Medical Group"), may keep your information for as long as is necessary to meet legal requirements, settle disputes, and/or enforce agreements, as well as for as long as is necessary to deliver the products or Services that you have requested from us. Except where obliged by law, we may dispose of such information at any time.

Third-Party Services

Remedy Well conducts business with a number of third-party services; as a result, this Privacy Policy does not address the privacy, information, or other practices of any third parties, including, without limitation, our associated MSO, Medical Group, Providers, laboratory providers, pharmacies, or any other third-party mobile application or website, or service to which our Service may contain a link. These third parties might occasionally collect data from or about you. We have no influence over and bear no liability for these third parties' practices regarding privacy. We advise you to ask questions and read each of their privacy statements.

How We Protect Your Information and Your Rights

Remedy Well employs a number of safeguards to protect your PHI from loss, intrusion, modification, and illegal access. All information is stored through a data management system. When you submit personal information on our website, it is protected both online and offline. Whenever we collect sensitive personal information (such as credit card data), that information is encrypted and transmitted to us in a secure way. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees or contractors who need the information to perform a specific job are granted access to personal information. The computers and servers in which we store personal information are kept in a secure environment.Although there are no private or secure electronic methods, by using our website, applications, and platform, you acknowledge and agree that we are unable to guarantee the security of any information you transmit using any of our Services, and that in proceeding, you are doing so at your own risk. You are in charge of keeping information that you deem confidential secure. You do, however, have the following rights regarding your information: Right to confidential communication of your medical information.Right to request a copy of your medical information.Right to request for an amendment of your medical information in writing. Marketing and Advertising

Remedy Well seeks to make others aware of our products and Services through marketing and advertising. You may, however, instruct us not to use your information to contact you by phone, email, or postal mail, regarding such products and Services, including promotions or events. You may request to “opt out” of such by emailing us with your specific request. It should be noted however, that regardless of this request we may still use and share certain information as is permitted by this Privacy Policy or by applicable law such as, for example, should we need to contact you regarding your experience or care with Remedy Well.

Your California Privacy Rights

(This information is useful for all residents in states with enhanced privacy laws) If you are a California resident, California law allows you to make certain requests about your personal information as well as requires us to provide you with such information regarding how we may collect, use, and disclose your personal information as outlined in the California Consumer Privacy Act (“CCPA”). Sale of Personal Information

The CCPA requires companies that "sell" (as defined in the CCPA) or otherwise shares personal information to provide you with a notice and opportunity to opt out. As a company that relies on marketing as our means of advertising Services, we work with certain third parties that provide those marketing services. As such, these third parties might place pixels, cookies, tags, and other similar tracking technology on our Website and application which may capture your online identifiers. It is recognized that under the CCPA, our marketing engagement may be considered a “sale” of personal information although we do not explicitly engage in the selling of your information. Shine the Light Disclosure

Under California Civil Code Sections 1798.83-1798.8 regarding the California "Shine the Light" law, residents of California may be entitled to obtain certain information from us regarding how we share certain categories of personal information with third parties for their direct marketing. We never give out your confidential information to third parties for their own direct marketing.

Notice for Nevada Residents

Under Nevada Privacy Law, certain Nevada consumers may elect to opt out of the disclosure or sale of their personal information. We do not sell your information. Nevertheless, if you are a Nevada resident who has purchased products or Services from Remedy Well, you may still request to opt out of any future sales. For requests to be completed, we require verification of your identity. Notice for Utah, Colorado, Connecticut, & Virginia Residents

Four additional states including Utah, Colorado, Connecticut, and Virginia have enacted comprehensive privacy laws designed to increase protections for consumers' personal information. As such, certain residential consumers may opt out of the sale of their personal information and may request access and/or deletion of certain personal information as detailed within this policy. Expanded Telehealth Privacy Policy, April 2023

Remedy Well’s independent telehealth Providers and Health Coaches do not represent a medical group. Any telehealth consults obtained through our website, applications, and/or platform are provided by independent Providers and coaches including, but not limited to, a network of United States based Providers. Collectively, we are required by law to maintain the privacy of your health information in accordance with federal and state law and in accordance with this Privacy Policy. If you do not agree to be bound by these terms, you are not authorized to access or use our website, applications, or platform.

Confidentiality

Providers and Health Coaches who use the Remedy Well platform shall not disclose information about you, or the fact that you are a client, without written and informed consent. Records maintained involve the Services provided, dates of sessions, functional status, symptoms, progress, and any screening tool, or lab reports. Health Care Providers are legally allowed to use or disclose records or information for treatment, payment, and other healthcare purposes. You may revoke permission, in writing, at any time, by contacting us at support@remedywellhealth.com. Limits to confidentiality have been outlined within the Privacy Policy and Terms of Use.

Entity Classifications

Remedy Well Inc. is a non-covered entity, even though our affiliated Medical Group is; as a result, they have created their own privacy guidelines that outline how they use and safeguard your PHI. For more details, please inquire by emailing us at support@remedywellhealth.com.  

Changes to This Privacy Policy

Remedy Well will adhere to the terms of the Privacy Policy currently effective. We reserve the right to change the terms of this Privacy Policy at any time, therefore it is advisable that you review it periodically for changes and updates. You are responsible for regularly reviewing this Policy for any updates. If we make a material change to the Privacy Policy, we will provide you with notice in accordance with legal requirements. Your continued use of our Website, applications, or platform after such amendments (and notice, where applicable) will be deemed your acknowledgment of these changes to the Privacy Policy.

By continuing to use this Website, including its applications, platform, and associated Services, you certify that you have had the opportunity to access and review the Privacy Policy, which describes the types of uses and disclosures of your protected health information that may occur. you acknowledge and agree that any information that you submit that is not intended or used for clinical/medical treatment and Services by our associated Medical Group, Health Care Providers, laboratory providers, and other pharmacies is not considered protected health information (PHI) and will only be subject to our Privacy Policy and applicable state laws that govern privacy and security. That is, whether the information is gathered from marketing or social media, if it is used to establish an account, purchase products, or see a Health Coach, that information is not considered PHI.
